USER’S RESPONSIBILITY OF COGNIZANCE OF THIS AGREEMENT

This website is published and maintained by TRAVEL GOODTIMES, a commercial entity incorporated and existing in accordance with the laws of the Republic of India. This page sets forth the terms and conditions under which TRAVEL GOODTIMES provides the information on this Website, as well as the terms and conditions governing your use of this site. The Users availing services from TRAVEL GOODTIMES shall be a natural or legal person and deemed to have read, understood and expressly accepted the terms and conditions of the agreement, which alone shall govern the desired transaction or provision of such service by TRAVEL GOODTIMES for all purposes, and shall be binding on the user. All rights and liabilities of the User with respect to any services to be provided by TRAVEL GOODTIMES shall be restricted to the scope of this agreement. If you do not accept these terms and conditions, do not continue to use or access this site, or order any searches.

In addition to this agreement, there are certain terms of service (TOS) specific to the services rendered/products provided by TRAVEL GOODTIMES like the air tickets, holiday packages, etc. Such TOS will be provided/updated by TRAVEL GOODTIMES which shall be deemed to be a part of this Agreement and in the event of a conflict between such TOS and this agreement, the terms of this agreement shall prevail. The user shall be required to read and accept the relevant TOS for the service/ product availed by the user.

Additionally, the Service Provider itself may provide terms and guidelines that govern particular features, offers or the operating rules and policies applicable to each Service (for example, flights, hotel reservation, Packages, etc). The User shall be responsible for ensuring compliance with the terms and guidelines or operating rules and policies of the services provided with whom User elects to deal, including terms and conditions set forth in a Service Providers’ fare rules, contract of carriage or other rules.

TRAVEL GOODTIMES’s Services are offered to the User conditionally on acceptance without modification of all the terms, conditions and notices contained in the agreement and the TOS, as may be applicable from time to time. For the removal of doubts, it is clarified that availing of the services by the User constitutes an acknowledgement and acceptance by the User of the Agreement and the TOS. If the User does not agree with any part of such terms, conditions and notices, the User must not avail TRAVEL GOODTIMES’s Services.

In the event that any of the terms, conditions and notices contained herein conflict with the Additional Terms and guidelines contained within any other TRAVEL GOODTIMES Document, then these terms shall be applicable.

COPYRIGHT POLICY

TRAVEL GOODTIMES holds the copyright in respect of this site, and the content provided in this site, including the text, graphics, button icons, audio and video clips, digital downloads, data compilations and software, may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed without the written permission of TRAVEL GOODTIMES, and/or its third party providers and distributors, except that you may download, display and print the materials presented on this site for your personal, non-commercial use only. PROMOTIONS / OFFERS / SCHEMES / CONTESTS

Please note that in case of special offers, promotions or schemes additional terms and conditions of these offers, promotions, schemes or contests will be applicable in addition to these terms and conditions. You might have to adhere to the payment schedule prescribed under such offers, promotions, schemes or contests in order to be eligible to avail benefits under such offers, promotions, schemes or contests. If you fail to make the payment by the due date and/or do not comply with all the terms and conditions of the offer, promotion, scheme or contest you would not be entitled to receive the benefit under such offer, promotion, scheme or contest. The Promotions / Offers / Schemes / Contests can also be discounted at any time without giving any specific notice

BASIC TRAVEL QUOTA

As per the current guidelines of RBI, all residents holding Indian Passport are entitled to avail an amount not exceeding US$ 2, 50, 000 or its equivalent in one financial year for one or more private/leisure visits under the Basic Travel Quota (BTQ). However, the traveller cannot avail in excess of US $ 3,000 per visit, or its equivalent in cash, except as specified in the exceptions provided by the RBI guidelines. It is mandatory for you to avail the foreign exchange component of the tour cost from under your BTQ entitlement from an authorized dealer licensed to provide such services as per the guidelines issued by RBI from time to time. You shall pay the foreign exchange component of the total tour cost at the prevailing rate to the dealer along with signed BTQ form & A2 form. You can draw foreign exchange for your personal use on tour from the same authorized dealer from your balance BTQ entitlement. This is as per GOI rules & regulations. You may carry this partly in currency, partly in traveller cheques (TC) which are safer and easily encashed for a small service fee. They can also be replaced if they are stolen or lost if you record TC numbers and retain counterfoil subject to the rules applicable.

PAYMENT TERMS FOR FOREX COMPONENT

1) The Forex(‘FX’) payment is a part of BTQ of the passenger.
2) The immediate family/kin, e.g. father can pay for the children; the mother can pay for the children stands well. However, the person paying/cardholder should also be among the travellers.
3) If the husband, wife and two children are travelling together as a family, husband’s card is acceptable.
4) The cardholder cannot use his/her card for payment of another person’s tour package.
5) The card that is swiped for payment of the tour’s foreign exchange should be of the cardholder himself/herself.
6) For packages with FX (Foreign Exchange) component only, the initial deposit amount collected in INR for booking shall be adjusted towards the balance FX component at the time of final FX payment.
7) The ROE (Rate of Exchange) for the entire FX component of the tour shall be considered as per the prevailing ROE on the day final payment is being made.

INTRODUCTION

We also track when you receive and read marketing communications from us, which information we use to improve our marketing services, provide you with more relevant information and improve the quality of our marketing materials. Additional information about the personal data we process in connection with marketing is included with the marketing communications we send you;

“Public Domain or Third-Party Data”: Data available in public domain or received from any third party including social media channels, including but not limited to personal or non-personal information from your linked social media channels (like name, email address, friend list, profile pictures or any other information that is permitted to be received as per your account settings) as a part of your account information.

“Profile Data”: including information collected progressively when you visit our site including your referral website, pages you visit, the actions you take, patterns of page visits and information from forms you fill in;

If you request TRAVEL GOODTIMES to provide foreign exchange (forex) related services then passport copies, A2 form, air tickets or travel authentication document to verify confirmed travel or any other documents required to process your Forex transaction

MODES OF COLLECTING PERSONAL DATA

The only way we will get any kind of personal data is if you choose to give it to us in the following circumstances:

(a) Direct interaction:

1. When you make an enquiry or quotation request or make a reservation or purchase from our ‘Website’ or through our customer service team – by email(s), letter(s), fax, on the phone or in a physical store
2. When you register with us, subscribe to our newsletter, enter in lucky draws/competitions/surveys/feedback, send us queries or register for promotions

  • send any updates or changes to your booking(s)

  • confirm your reservations with respective service providers

  • request for reviews of products or services or any other improvements
  • send verification message(s) or email(s)
  • validate/authenticate your account and to prevent any misuse or abuse

 TRAVEL GOODTIMES may from time to time launch promotions to give its Users an opportunity to win great travel and travel-related prizes.  TRAVEL GOODTIMES may launch travel referral or reward programs from time to time by way of which users would win travel-related rewards or other rewards. You may note that while making a booking with TRAVEL GOODTIMES you authorize us and consent to share your information with the said service providers and suppliers. It is pertinent to note that TRAVEL GOODTIMES does not authorize the end service provider to use your information for any other purpose(s) except as for fulfilling their part of service.

TRAVEL GOODTIMES does not sell or rent individual customer names or other Personal Information of Users to third parties except sharing of such information with our business/alliance partners or vendors who are engaged by us for providing various services and for sharing promotional and other benefits to our customers from time to time basis their booking history with us.

Third Party Vendors and Business Partners:

We may also share certain filtered Personal Information to our corporate affiliates or business partners who may contact the customers to offer certain products or services, which may include free or paid products/services, which will enable the customer to have better travel experience or to avail certain benefits specially made for TRAVEL GOODTIMES customers. Examples of such partners are entities offering savings/EMI on travel, co-branded credit cards, travel insurance, insurance cover against loss of wallet, banking cards or similarly sensitive information etc. If you choose to avail any such services offered by our business partners, the services so availed will be governed by the privacy policy of the respective service provider.

TRAVEL GOODTIMES may share your Personal Information to the third party that TRAVEL GOODTIMES may engage to perform certain tasks on its behalf, including but not limited to payment processing, data hosting, and data processing platforms.

We may provide non-personal data based on this data to suppliers, advertisers, affiliates and other current and potential business partners. We may also use such aggregate data to inform these third parties as to the number of people who have seen and clicked on links to their websites.

Occasionally, TRAVEL GOODTIMES will hire a third party for market research, surveys etc. and will provide information to these third parties specifically for use in connection with these projects. USER GENERATED CONTENT

TRAVEL GOODTIMES provides an option to its users to post their experiences by way of reviews, blog articles, ratings and general poll questions. The customers also have an option to give their feedback or ask questions w.r.t a service offered by TRAVEL GOODTIMES or post answers to questions raised by other users. TRAVEL GOODTIMES may also engage a third party to contact you and gather your feedback about your recent booking with TRAVEL GOODTIMES. Though the participation in the feedback process is purely optional, you may still receive emails, notifications (app, SMS, WhatsApp or any other messaging service) for you to share your review(s). These reviews may be written (with or without images) or in video format. The reviews written or posted will be visible on TRAVEL GOODTIMES and may also be visible on other travel or travel related platforms. The User Generated Content that TRAVEL GOODTIMES collects may be of the following kinds:

 Review and Ratings
 Question and Answers
 Crowd Source Data Collection (poll questions).

Each User who posts review or ratings, Q & A, photographs shall have a profile, which other Users will be able to access. Other Users may be able to view the number of trips, reviews written, questions asked and answered and photographs posted

CANCELLATION OF THE TOUR BY CLIENT:

As the services to be provided to the tour participants are booked several months in advance, cancellation of such services earmarked for a particular departure results in the Enterprise losing money depending upon the time of cancellation to the supplier. Therefore, any cancellation of tour/services booked by a tour participant will attract cancellation charges along with GST of 18%, as specified. If the Tour participant books a third-party product or service, the Terms and Conditions and Cancellation Policy of such third-party would be applicable in addition to our Terms and Conditions. Any cancellation of tour/services has to be in writing clearly stating the reasons for cancellation.
If circumstances make you cancel your tour, the cancellation must be intimated to us by email at holidayadvisor@goodtimes.co.in

If you wish to cancel your tour, you must intimate us as follows provided that such intimation should be in writing duly signed by each of the Clients seeking cancellation and given on a working day within working hours:

Similarly, if your Travel Agent cancels, it will be deemed and construed that all the clients and you agree with the same. The computation of the period of notice of cancellation shall commence only from the time the written request reaches us as per the details listed above.

We reserve the right to determine the quantum of refund payable in case of cancellation or amendment of a Tour due to Force Majeure or Vis Majeure. Such refund would be based on various factors like the number of participants, the Cancellation Policies of suppliers like hoteliers, airlines, coach operators, etc. and the decision of us on the quantum of refund shall be final. Even for payments made in foreign currency with or without part payment in Indian rupees, the said refund shall be made only in Indian Rupees at the prevailing buying rate of exchange on the date of refund as per existing Rules & Regulations without interest.
Refunds (if any) for amendments and/or cancellations will be made directly to Clients by us after deducting applicable GST. In case of refund in foreign currency component, the said refund shall be made in INR only at the prevailing buying rate on the date of refund as per existing statutes, rules and regulations. It would take at least 60 days depending upon the refund policy of suppliers to process such refunds.
VISA fees are non-refundable under ALL circumstances, even if the same is rejected by the issuing authorities for reasons beyond our control.

In case we exercise our discretionary rights to alter, amend or cancel any Tour or tour advertised, the Client who has booked for such Tour can exercise the option:

  • To continue with the Tour as altered or amended; or
  • To accept any alternative Tour, which we may offer; or
  • To unconditionally accept the return of the tour cost charges (after deduction of the actual expenses incurred by us on your booking like visa, insurance premium, ticket voiding charges, POE charges and other overheads as applicable from case to case) in full and final settlement and we shall not be liable/responsible to pay the Client, compensation, consequential loss, damages, additional expenses or interest charges over and above as is computed by us as per these ‘Terms & Conditions’. The Client will not be entitled to make any grievance thereafter in respect of the same.

In the case of the Client travelling on an amended Tour, the legal relationship between the parties shall not change only by virtue of the amendment. The Client opting to continue with the tour arrangements as altered or amended shall pay additional charges if any levied by us.

RATE OF EXCHANGE APPLICABLE TO REFUNDS:

Please note that refunds of foreign exchange component of the tour cost will be based on our buying rate of that date. When we receive Indian Rupees from you in relation to a booking, we convert them into the foreign exchange component of the tour cost at our selling rate, then applicable and credit the proceeds in our bank account. When we refund the foreign exchange component to you in Indian Rupees, we do so at our buying rate applicable on the date of refund, because the bank will convert the money at the buying rate and credit the same in Indian Rupees.

NO REFUND FOR UNUTILIZED SERVICES:

It is clearly understood that there shall be no refund or compensation whatsoever for unutilized services. This general rule applies to all kinds of non-utilization or under-utilization of tour services, whether of the whole or part of the tour and whether as a matter of your choice or caused by your fault or compelled by circumstances such as ill-health, weather, external factors etc.

As a consequence of the above rule, please note that no refund will be admissible in the following circumstances (amongst others).

  • If you fail to join the tour at the commencement of the tour or join later or leave before the culmination of the tour for any reasons whatsoever.
  • If you fail to or are unable to utilize any of the services on the tour like airline travel, hotels, sightseeing, rides, cruises, meals, entrance fees, optional tours etc. due to any reason whatsoever such as late reporting, ill-health etc.
  • If you terminate your participation in the tour due to your own fault, negligence or breach of these Terms.
  • In the case of multi-country package tour wherein, there may be a requirement for Visa of multiple jurisdictions, there will be no refund if Visa is rejected due to which you are unable to travel to that specific destination for which the Visa has been rejected or delayed.

INTERPRETATION:

As to the interpretation of the aforesaid terms and conditions, our decision shall be final and binding upon you. We reserve the right to change the Terms & Conditions at any time without any prior notice and without assigning any reasons thereof.
